7-23-14 rape-prior relationship

MADISON, Wis. (AP) — The Wisconsin Supreme Court says evidence showing that a man convicted of raping a woman had a prior sexual relationship with her was properly excluded at trial.  The court on Tuesday reversed a state appeals court ruling that found in favor of Muhammad Sarfraz of Milwaukee. The Supreme Court sent the case back to the appeals court to rule on other issues Sarfraz raised on appeal.  He was found guilty of second degree sexual assault in 2011 and sentenced to 10 years in prison.  Sarfraz argues that evidence should have been allowed that shows he had prior consensual sexual contact with the woman who accused him of rape.  The Supreme Court disagreed, saying the evidence was properly excluded under the state’s rape shield law.
