8-28-15 what happened to ordinance 1859?

A former Fond du Lac city council and staunch defender of Lakeside Park is expressing concern about any recommendations from an exploratory committee in the area of commercial development at the park.  Kathy Walz says she was surprised to learn that a direct legislation ordinance approved by the city council  more than 40 years ago is apparently no longer on the books.  Walz says that ordinance required any proposed commercial development at the park be put to a public referendum.  Walz says its her understanding that if the ordinance was ever rescinded it had to be done by referendum.  “Direct legislation isn’t the same as when the city council passes a resolution because its done by the people,”  Walz told WFDL news.  Walz says when she asked for a copy of the ordinance she was told by the city attorney it was no longer on the books.  Fond du Lac city attorney Deb Hoffman says the ordinance was never purged. She says it was never codified.  “It never officially got entered into our code, so it wasn’t part of our ordinances,”  Hoffman said.  “It wasn’t that it was purged, that didn’t happen.  It appeared to me that it was going on the path to have direct legislation but I don’t believe that got completed and instead the council passed a resolution and said there would be no development.”
