MADISON, Wis. (AP) — Attorney General Brad Schimel says state environmental officials lack broad authority to regulate high-capacity wells. Schimel issued an opinion Tuesday saying a 2011 law prohibits agencies from imposing permit conditions not expressly laid out in state statute. Republicans and environmentalists have argued for years over how far the Department of Natural Resources can go in regulating high-capacity wells. A state appeals court ruled in 2010 that the agency has broad authority to control such wells. That prompted Republicans to pass the 2011 law limiting agency authority to statutory powers. The state Supreme Court ruling upheld the appellate ruling in 2011 but didn’t consider the new law because it didn’t go until effect until oral arguments were over. Assembly Republicans asked Schimel for the opinion in February.
