A major victory for supporters of an alternative master plan at Fond du Lac’s Lakeside Park. A Winnebago County Circuit Court judge has dismissed a lawsuit and temporary injunction that would have prevented the city from taking further action to develop Lighthouse Point or Oven Island. The lawsuit was filed last October by a citizens group opposed to an alternative master plan challenging the city council’s denial of the group’s petition to put the question on the April ballot in the form of a referendum. The judge agreed with the attorney representing the city that the petitions be denied based on state statute that they cannot oppose actions already taken by council and are administrative and not legislative. Council president Brian Kolstad says he was surprised by the judge’s decision, but says he believes it was the correct decision.
