Fond du Lac’s Agnesian HealthCare and its physician group will pay $10 million to the federal government and the state of Wisconsin to settle a whistleblower case. The case was brought by orthopedic surgeon Doctor Clark Searle who alleged the hospital paid doctors kickbacks and other financial incentives to get patient referrals. The lawsuit contends Agnesian defrauded government-funded health care programs by compensating doctors who brought in more business. Agnesian issued a statement denying the allegations, and making no admissions of liability or wrongdoing. According to a press release, Searle repeatedly raised concerns about the compensation system and tried unsuccessfully to get it revised. He served on the Fond du Lac Regional Clinic Board from 2010 to 2013 and worked at the clinic until July 2017. Searle said he is glad the matter is resolved and says he brought the lawsuit out of the concern for the interest of his patients.
